The draft decree seeks to strengthen supervision and enforcement, establish objective criteria for determining fines, and update provisions on audits, information reporting, financial guarantees, and operating authorizations. Stakeholders and members of the public will have 15 calendar days to submit comments.
Peru’s Ministry of Foreign Trade and Tourism (Mincetur) has published a draft supreme decree proposing amendments to the regulations governing Law No. 31557, which regulates remote gambling and remote sports betting in the country. The initiative aims to clarify the obligations and prohibitions applicable to authorized operators and strengthen the mechanisms used to supervise and enforce compliance across the sector.
Approved through Ministerial Resolution No. 382-2026-MINCETUR, the proposal covers amendments to the regulations established under Supreme Decree No. 005-2023-MINCETUR, together with the corresponding explanatory memorandum.
As part of the public consultation process, the draft will be available on Mincetur’s official digital platform for 15 calendar days. The ministry is seeking comments, contributions, and opinions from public and private entities, civil society organizations, and interested individuals.
Greater clarity on authorized operators’ obligations
According to the rationale accompanying the proposal, one of its main objectives is to improve the clarity, predictability, and effectiveness of the regulatory framework governing remote gambling and sports betting.
To achieve this, the draft proposes clarifying certain obligations and prohibitions applicable to authorization holders operating remote gambling and sports betting technology platforms, as well as remote sports betting gaming rooms.
These adjustments are intended to define more clearly the requirements operators must meet under Peru’s regulatory framework.
Supervision, audits, and authorization requirements
The initiative also seeks to optimize Mincetur’s supervision and enforcement mechanisms while updating operational provisions concerning information reporting, audits, financial guarantees, and authorization requirements.
These areas form part of the mechanisms used to oversee compliance with regulatory obligations by authorized operators.
The draft also proposes expressly regulating the procedures for declaring seized assets abandoned, as well as their subsequent disposal and destruction, establishing specific provisions for handling such cases.
Proposed objective criteria for imposing fines
Another key element is the introduction of objective criteria for determining and imposing fines.
According to Mincetur, the measure is intended to promote the consistent, proportionate, and effective application of the regulations. The proposal also supports broader objectives, including strengthening player protection, combating illegal gambling, and safeguarding the public interest.
The initiative therefore represents a proposed update to the regulatory framework, addressing both operators’ obligations and the procedures governing supervision and sanctions.
How to submit comments on the proposal
Individuals and organizations interested in contributing to the consultation can submit their comments during the 15-calendar-day publication period through the following channels provided by Mincetur:
- Official website: www.gob.pe/mincetur
- In-person submissions: Mincetur’s administrative office at Calle Uno Oeste No. 050, Córpac urbanization, San Isidro district, Lima.
- Email: apuestasdeportivas@mincetur.gob.pe
The General Directorate of Casino Games and Slot Machines, under the Vice Ministry of Tourism, will be responsible for receiving, organizing, and analyzing the submissions.
The public consultation provides an opportunity for industry stakeholders, organizations, and members of the public to contribute comments and proposals regarding the planned changes to Peru’s remote gambling and sports betting regulations.
The proposal remains subject to public consultation. It is a draft regulatory measure, not a set of amendments that has already entered into force.
